About these terms
These terms are an agreement between you and Scadex, trading as Mailumi, a sole proprietorship (eenmanszaak), Stalpaert van der Wielestraat 12, 5344 VR Oss, the Netherlands, registered with the Dutch Chamber of Commerce (KvK) under number 42065103, VAT number NL005468347B34 (“Mailumi”, “we”). By creating an account you accept them. If you use Mailumi for a company, you confirm you may accept them on its behalf.
Your account
Give accurate details and keep your password and API keys secret. You are responsible for everything done with your account and keys. Tell us straight away if you think your account has been misused.
Acceptable use
Only send email to people who asked to receive it, include a working unsubscribe link in marketing email and honour unsubscribes promptly. Do not send spam, phishing, malware, illegal content or email that impersonates someone else, and keep bounce and complaint rates low. We may pause sending or suspend an account to protect recipients and our sending reputation. Report abuse to abuse@mailumi.com.
Your domains and content
Only add domains you control. You keep all rights to your content and give us permission to process it only as needed to provide the service.
Plans and payment
- Prices are shown on the pricing page in US dollars, excluding applicable taxes. Paid plans are charged monthly in advance by card through Stripe. Emails above your plan’s monthly allowance are charged at your plan’s published rate on your next invoice. Plan changes take effect immediately and are prorated.
- Subscription fees are charged in advance for each monthly period and are not refunded for partial months, unless the law that applies to you requires otherwise.
- If a payment fails, we will retry it and let you know. If it remains unpaid, your workspace may move to the Free plan.
Cancellation
Cancel at any time in Manage billing. Your paid plan stays active until the end of the period you paid for, then your workspace moves to the Free plan. You can close your account at any time by contacting support. We may end or suspend your access if you seriously or repeatedly break these terms.
Data protection
Our privacy notice explains how we handle personal data. For personal data in the email you send and receive, you are the controller and we process it only on your instructions to provide the service. Our Data Processing Agreement is part of these terms and applies automatically; a signed copy is available on request from privacy@mailumi.com.
The service
We work to keep Mailumi available and secure, but we cannot guarantee uninterrupted service. Recipient mail servers decide whether to accept a message and where to place it, so we cannot guarantee inbox placement. We may improve and change features; we will give notice before removing something you rely on.
Liability
Nothing in these terms limits liability that cannot be limited by law. Otherwise, we are not liable for indirect or consequential losses, lost profits or lost data, and our total liability for any claim is limited to the fees you paid us in the 12 months before the claim.
Changes to these terms
We will tell you about material changes by email at least 30 days before they take effect. If you do not agree, you can cancel before then.
Law and disputes
These terms are governed by Dutch law. Disputes are handled by the District Court of Oost-Brabant (Rechtbank Oost-Brabant) in ’s-Hertogenbosch, the Netherlands, unless the law that applies to you as a consumer gives you the right to go to your local courts.
